Our websites are to be used only for lawful purposes.  The information presented here is for informational purposes only, and it is your responsibility to ensure the accuracy and reliability of any information as it relates to your particular requirements.  We have no responsibility for or control over any information contained in third-party websites, including outbound links from our website. All content is subject to copyright and trademark protection, to the fullest extent permitted by law.  All aspects of this website are subject to change without notice.

Sales Taxes:

As of December 2021, Sea-Tech Systems is obligated to collect retail sales taxes for all retail sales where products are delivered to Washington, Idaho, or Florida.  Sales taxes will be automatically calculated by the website and charged with the product sale based on the shipping address provided by the customer.

Sales Taxes are collected on hardware, software, and subscription digital goods such as email and weather services.

Wholesale purchases are tax-exempt ONLY if Sea-Tech Systems has a valid reseller certificate on file for the customer location.

Shipping:

Some of our orders ship same-day, and others require 1 or more days of processing.  Same-day shipping depends on our inventory, 3rd party warehouse inventory, day and time order was submitted, and other factors.

Sea-Tech Systems ships product from our own inventory/warehouse(s) in Idaho and Washington as well as through 3rd party distributors, manufacturers, and logistics providers depending on the product, stock levels at the time of order, delivery destination, and other factors.

Sea-Tech reserves the right to choose the best shipment carrier (including but not limited to UPS, USPS, FedEx, and DHL Express) depending on shipment origin, destination, dimensions, and promised ETA.

While Sea-Tech Systems makes every attempt to deliver products to our customers within the expected delivery timeframe, we are unable to guarantee delivery within any specific timeframe.  As of 2021 and into 2022, shipment carriers have suspended some or all of their delivery guarantees and while we have seen generally good success with deliveries arriving on time, it is not always the case.

Tracking:

Shipments sent from our own warehouses will generate automatic tracking information and emails which are sent to the email address on file for the order/customer.

Shipments sent through a 3rd party do not generate automatic tracking emails from our system however we do make an attempt to forward tracking information we receive to our customers as soon as we receive it from our vendors. 

We do not always receive tracking information in a timely fashion, or at all, from our vendors and as such we cannot provide tracking information in all cases.

If you have not received tracking information for your order, you may email (sales@sea-tech.com) or call (+1-206-792-9540) to request it and we will provide any tracking information we do have for your order.

We do not accept returns on software, activations, or on satellite airtime or other intangible or digital products.  No refunds will be issued for these items. For all other goods, we accept returns within 30 days of the date of purchase, subject to the following: all returns must be new, unopened, in original packaging, in the exact same condition in which the product was received.  All returns are subject to a 25% restocking fee; no refunds on shipping.  Return shipping costs will be paid by the buyer, except that Sea-Tech will reimburse shipping for goods determined to be defective.  Prior to returning any products, all returns must have a return authorization.  There will be no refunds on returns that do not have RMA authorizations.  To obtain a return authorization, contact support@sea-tech.com.

Refunds not possible on some Satellite/VSAT systems: For some products, refunds are not possible.  For example, certain large satellite Internet systems (including Cobham Sailor, Viasat, Aura, Intellian, KVH, and some others) are not returnable once shipped unless there is a defect.  Please ask for more information if you are considering those types of systems and are concerned about the ability to return a system for any reason.

Sea-Tech will process authorized returns and refunds within 10 business days.

Sea-Tech Systems employs numerous tools and processes to detect possible fraud for our web, email, and phone orders.   We make use of all tools provided by our credit card processors, web hosts, and any other method we feel appropriate to verify orders and we reserve the right to cancel any order that appears to be fraudulent without warning.

Sea-Tech Systems prosecutes perpetrators of fraud to the fullest extent of the law.

Quality of Service. Sea-Tech makes no guarantee, warranty, promise, or any other commitment to you regarding the quality and/or availability of the Services. Sea-Tech shall not be liable for any outage of, or any other reduction of or interference with, the Services beyond a pro-rated discount on your bill for the amount of time that the outage of Services exists.  Except as set forth above in this Section 4, Sea-Tech shall not be liable for any other damages, including, but not limited to, incidental, consequential, punitive, or any other type of damages, related in any way to any outage of, or any other reduction of or interference with, the Services. 

Support.  Please contact us directly for your support needs.  As cruisers ourselves, we know how important support is.  So, we go to great lengths to provide digital nomads with our best available support.  If you need any help with any of your Services, please email us at support@sea-tech.com.  

Customer Information.  Sometimes we need to share customer information (e.g. name, location, applications used on the Services) with third parties, primarily the satellite network provider (“Provider”), for certain operational reasons (e.g. providing customer support, initiating Services, and other operational needs).  We respect our customers’ privacy and only do so when necessary.  When we do have to share your customer information, we endeavor to have any third parties handle and treat your customer information as confidential information that must not be disclosed or used in any way or for any reason other than the purpose of our disclosure to that third party.  We will never sell your information.  By signing up for any Services, you hereby agree to and consent to our use and disclosure of your information for these purposes. 

Changes to Services Provided.  From time to time, our suppliers may make changes to the services they provide, or to the costs of the services they provide.  If any change affects your Services or the pricing of your Services, we will notify you as soon as we practically can.  If you are unhappy with any of the changes, you may cancel or suspend your Services as provided in Paragraph 3 of this Agreement.

Permitted Use And Restrictions On Use.

  1. Software License. Subject to the terms of this Agreement, Provider grants to you a personal, non-exclusive, non-assignable and non-transferable license to use and display the software provided by or on behalf of Provider (including any updates) (“Software”) only for the purpose of accessing the Internet access service to which you have subscribed (“Service”) on any device(s) on which you are the primary user or which you are authorized to use.  Each Provider’s Subscriber Privacy Policy available on their own website provides important information about the software applications we utilize.  Please read the terms very carefully, as they contain important disclosures about the use and security of data transmitted to and from your devices through the Service. Unauthorized copying of all or any portion of the Software, including, without limitation, portions or items that have been merged with the Software, or the written materials associated therewith is expressly forbidden.  You may not sublicense, assign, or transfer this license or the Software except as permitted in writing by Provider.  Any attempt to sublicense, assign or transfer any of the rights, duties or obligations under this license is void and may result in termination by Sea-Tech Systems or the Provider of this Agreement.  You agree that you will not copy, distribute, decompile, or duplicate or permit anyone else to copy, distribute, decompile, or duplicate, any part of the Software, or create or attempt to create, or permit others to create or attempt to create, by reverse engineering or otherwise, the source programs or any part thereof from the object programs or from other information made available under this Agreement. The license granted under this Section terminates upon termination of the Agreement or termination of the Service.
  2. Restrictions On Use Of The Service. You agree to comply with Provider’s Acceptable Use Policy.  You also acknowledge and agree that the Service is subject to Provider’s Network Management Policy.  Provider reserves the right to immediately terminate the Service and this Agreement if you knowingly or otherwise engage in any prohibited activity under such policies, which are available at each Provider’s respective websites  You do not own or have any rights (other than those expressly granted to you) to a particular IP address, even if you are utilizing a persistent IP address. 
  3. Prohibition on Resale. You agree not to use the Service for operation as a Service provider, or to run programs, equipment, or servers from the designated installation location that provide network content or any other similar services to anyone outside of such location.
  4. Security. You agree to take reasonable measures to protect the security of any devices you connect to the internet through the Service, including, without limitation, maintaining at your cost an up-to-date version of anti-virus and/or firewall software to protect your devices from malicious code, programs or other internal components (such as a computer virus, computer worm, computer time bomb or similar component).  You expressly agree that if your computer or an internet connected device becomes infected and causes any of the prohibited activities listed in Provider’s Acceptable Use Policy, Reseller may immediately suspend your Service until such time as your computer or device is sufficiently protected to prevent further prohibited activities.  You will be fully liable for all monthly fees and other charges under this Agreement during any period of suspension.  Although Provider has no obligation to monitor the Service or its network, Provider and its authorized suppliers reserve the right to monitor bandwidth, usage, transmissions, and content from time to time in order to operate the Service, identify violations of this Agreement, or to protect the Provider’s network, the Service, and other users of the Service. In all cases, you are solely responsible for the security of any device you choose to connect to the Service, including, without limitation, the security of any data stored or shared on such device(s). 

    Privacy. Provider’s privacy policy can be found at their own website (“Privacy Policy”). The Privacy Policy explains Provider’s practices relating to the collection and use of your information through or in connection with the Services. Provider’s use of your information is governed at all times by our Privacy Policy. You understand that through your use of the Services you consent to the collection and use of this information (as set forth in the Privacy Policy). If you do not agree to the terms of this Privacy Policy, please do not use the Services.

    Warranties and Limitations of Liability.

    1. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR AND YOUR GUESTS’, PATRONS’, EMPLOYEES’ AND OTHER END USERS’ SOLE RISK.  RESELLER, PROVIDER AND RESELLER’S AND PROVIDER’S AFFILIATES, SUBSIDIARIES, WHOLESALERS, RESELLERS, RETAILERS, DISTRIBUTORS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, EMPLOYEES, SUPPLIERS, LICENSORS AND THIRD-PARTY CONTENT PROVIDERS (COLLECTIVELY, “PARTNERS”) DISCLAIM ANY AND ALL WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, AS WELL AS ANY AND ALL WARRANTIES AS TO THE RESULTS TO BE OBTAINED FROM THE USE OF THE SERVICE, INCLUDING, WITHOUT LIMITATION, ANY MINIMUM UPLOAD OR DOWNLOAD SPEEDS AND LATENCY PERFORMANCE.  THE SERVICE IS DISTRIBUTED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE,  IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES AS TO ACCURACY, COMPLETENESS OF INFORMATIONAL CONTENT, AND NON-INFRINGEMENT.  RESELLER, PROVIDER AND THEIR RESPECTIVE PARTNERS EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY THAT THE SERVICE WILL BE ERROR FREE, SECURE, OR UNINTERRUPTED, OR WILL OPERATE AT ANY MINIMUM SPEED.  NO ORDER, ADVICE OR WRITTEN INFORMATION GIVEN BY RESELLER, PROVIDER OR THEIR RESPECTIVE PARTNERS WILL CREATE A WARRANTY NOR MAY YOU RELY ON ANY SUCH INFORMATION OR ADVICE.  WHILE PROVIDER PROVIDES YOU WITH ELECTRONIC ACCESS TO THE CONTENT AVAILABLE ON THE INTERNET, RESELLER, PROVIDER AND THEIR RESPECTIVE PARTNERS DO NOT WARRANT THE ACCURACY OF THE INFORMATION YOU OBTAIN THROUGH THE SERVICE.  RESELLER, PROVIDER AND THEIR RESPECTIVE PARTNERS HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGE TO OR LOSS OR DESTRUCTION OF ANY HARDWARE, SOFTWARE, FILES OR DATA RESULTING FROM YOUR USE OF THE SERVICE.
    2. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER RESELLER, NOR PROVIDER, NOR THEIR RESPECTIVE PARTNERS ARE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE, INABILITY TO USE THE SERVICE OR ANY BREACH OF ANY REPRESENTATION OR WARRANTY. WITHOUT IN ANY WAY LIMITING THE FOREGOING, IF FOR ANY REASON, BY OPERATION OF LAW OR OTHERWISE, ANY PORTION OF THE FOREGOING LIMITATION OF LIABILITY IS VOIDED, THEN IN SUCH EVENT PROVIDER AND RESELLER’S MAXIMUM, SOLE, AND EXCLUSIVE LIABILITY AND THE LIABILITY OF THE PARTNERS IS LIMITED TO GENERAL MONEY DAMAGES IN AN AMOUNT NOT TO EXCEED THE TOTAL AMOUNT ACTUALLY PAID TO RESELLER BY YOU FOR THE APPLICABLE SERVICE FOR THE PERIOD OF TIME COMMENCING UPON THE OCCURRENCE OF SUCH ERROR, DEFECT OR FAILURE AND CEASING UPON THE DISCOVERY OF SUCH ERROR, DEFECT, OR FAILURE, IN WHOLE OR IN PART; PROVIDED, HOWEVER, THAT IN NO EVENT WILL SUCH PERIOD OF TIME EXCEED TWELVE (12)-MONTHS. THE PARTIES ACKNOWLEDGE THAT THIS SECTION HAS BEEN INCLUDED AS A MATERIAL INDUCEMENT FOR RESELLER AND PROVIDER TO ENTER INTO THIS AGREEMENT AND THAT RESELLER AND PROVIDER WOULD NOT HAVE ENTERED INTO THIS AGREEMENT BUT FOR THE LIMITATIONS OF LIABILITY SET FORTH HEREIN. 

    No Residential or Military Use.  Your satellite airtime Services are intended for non-residential and non-military use.  You agree to not use your satellite airtime Services at residential locations and for any military use.  You also represent and warrant that you are not a commercial reseller of the Services and that you will not resell any of the Services to any third-parties, except for collecting reimbursement of costs for the Services provided to your clients, charter guests, crew, and the like.

    Governing Law.  This Agreement shall be governed, construed and interpreted in accordance with the laws of the State of Washington.  The parties to this Agreement irrevocably consent to the personal jurisdiction of and venue in the state and federal courts located in King County, Washington with respect to any action, claim or proceeding arising out of or relating to this Agreement.

    Authorization.  I authorize Sea-Tech Systems to auto-debit my account below for any and all charges due.  I understand that my information will be saved to file for future transactions to my account, and I agree to keep my payment information current as long as I am continuing to utilize Sea-Tech services.

    General Terms and Policies

    Iridium Go, Redport Glow, and Iridium Handheld Monthly Plans

    Sales Taxes:

    As of December 2021, Sea-Tech Systems is required to collect sales taxes in Washington, Idaho, and Florida.  Sales taxes do NOT apply to satellite airtime; however, they DO apply to other services such as CruisersEmail, Xgate, and PredictWind.  Customers with billing addresses in WA, ID, or FL will see sales taxes added to their Email and Weather services.

    Contract Terms:

    For our monthly plans, we offer both 12-month contract terms and month-to-month terms.  To activate with a month-to-month plan, a $50 contract waiver is billed at the time of initial activation.  All other activations will be assigned to a 12-month contract term.

    For plans that allow suspend and resume features, only the active months are counted toward contract term fulfillment.  Example:  For a plan that is active for 6 months, suspended for 3 months, and then resumed, 6 months remain on the contract even though 9 months of total time have passed.

    With both 12-month contracts and month-to-month services, the plan can be suspended and resumed.   The only difference is that a full 12 months of active service must be paid on the 12-month contract before the service can be completely cancelled/deactivated.  (i.e.: the early termination fee for a 12-month contract is equivalent to the monthly cost of the plan X the number of months remaining on the contract.)  There is no ETF for month-to-month plans.

    Per-Minute billing is rounded up to the nearest whole minute for each satellite call (data or voice)

    Activation, Suspend, Resume, and Cancellation Requests:

    Suspends and resumes require minimum 72-hour notice — 72 hours before end of month for suspends and cancellations, 72 hours before desired activation date for activations and resumes.  Sea-Tech Systems attempts to perform requested changes as quickly as possible, but it is not possible to guarantee that a change can be made in less than 72 hours under all conditions.   This is especially important for cancellations and suspend requests, as all of those occur at the end of the calendar month and there is no way to backdate the change.  Also, many satellite operators run on UTC or Australia time zones which means their billing month is from many hours to almost a whole day before the USA’s end of month.

    Rush Suspend and Cancellation Requests:

    If you request a plan change request with less than 72 hours’ notice, we cannot guarantee that the change will be made in time.  If you need to make a change and it is already within the 72-hour period, you may call our business number (+1-206-792-9540) to speak with us, and we will be able to tell you if it’s possible to make the change in the time remaining.

    Successful rush plan change requests (under 72 hours’ notice) will incur a $10 service fee.  There will be no fee if we are unable to complete the change in time, and your change will be rescheduled to the next billing cycle.

    General Terms for Activation, Suspend, Resume, and Cancellations

    Activating New Service:

    • Activations can be done on any day of the month and can be scheduled in advanced if requested. Activations can take from 1 hour to 72 hours to complete depending on system delays, periodic scheduled and unscheduled maintenance, and other factors.
    • Customers must complete the online billing form for the desired plan prior to activation.
    • The Contract Waiver Fee will be charged at the time of activation (if month-to-month service is selected)
    • The first month of service will be prorated based on the activation request date. For example, if the activation is submitted on Jan 15, the first month billing will be prorated for the 15th through the 31st.  Note: Any metered voice, sms, or data services included in the plan will be prorated as well.  For example, if the plan is prorated at 1/2 of the month, the included minutes for that month will also be prorated to 1/2 of the monthly included amount.

    Suspending an Active Service Plan:

    • Suspension of service plans (i.e.: for seasonal use, etc.) are always completed at the end of the calendar month. Mid-month suspends are not possible.   Suspension of an active plan can be scheduled in advance if requested.
    • The plan MUST be active for at least a full 30 days before it can be suspended. (For example, if a plan is activated or resumed on Mar 10th, the first date on which it can be suspended is Apr 30th.
    • The monthly “suspend” fee will be charged each month while the plan stays in suspended status. The monthly suspend fee is currently $5 USD per month
    • CruisersEmail, Xgate, and PredictWind monthly add-ons can be suspended as well and there is a $5 per month suspend fee for these services as well.

    Resuming Service from Suspended Status:

    • Resumptions can be done on any day of the month and can be scheduled in advanced if requested. Resumption can take from 1 hour to 72 hours to complete depending on system delays, periodic scheduled and unscheduled maintenance, and other factors.
    • The invoice generated at the time of resumption will be prorated based on the requested resume date. For example, if the resume is submitted on Jan 15, the billing will be prorated for the 15th through the 31st.   The monthly $5 Suspend fees are not credited or prorated upon resumption of service. Note: Any metered voice, sms, or data services included in the plan will be prorated as well.  For example, if the plan is prorated at 1/2 of the month, the included minutes for that month will also be prorated to 1/2 of the monthly included amount.
    • Resuming CruisersEmail, Xgate, and PredictWind monthly add-ons can be resumed when needed, but mid-month resumes will incur the full monthly fee, they cannot be prorated.

    Cancellation of Service:

    • Cancellation of service plans are always completed at the end of the calendar month. Mid-month cancellations are possible but there will be no credit for the unused portion of the month.   Cancellation of an active plan can be scheduled in advance if requested.
    • The plan MUST be active for at least a full 30 days before it can be cancelled. (For example, if a plan is activated or resumed on Mar 10th, the first date on which it can be cancelled is Apr 30th.
    • For 12-month contract plans, for any remaining unfulfilled contract months, the monthly plan fee X remaining months will be charged as an ETF.
    • For month-to-month plans, there is no ETF fee.
    • After Cancellation, +1 SIMs can be reactivated later with the same month-to-month or 12-month term options as with initial activations. +8816 SIMs can be reactivated however the reactivation fee is $300.   A new SIM can be requested from Sea-Tech Systems for just the cost of postage if a new activation is desired.

    Iridium Certus 100, 200, 350, and 700 Monthly Plans

    Sales Taxes:

    Certus plans have 1 or 3-month terms depending on plan.  After the initial term, all plans become month-to-month plans…  To activate with a new Certus, a $50 activation fee is billed at the time of initial activation. 

    Per-Minute billing is rounded up to the nearest whole minute for each satellite call (data or voice)

    Certus 100 maximum upload and download speeds are 22kbps and 88kbps respectively, Certus 200 maximum upload and download speeds are 172kbps in both directions, and Certus 700 maximum upload and download speeds are 352kbps and 702kbps respectively.   Certus 350 has been upgraded to Certus 700 and no longer applies.  Actual speeds will vary due to network, weather, and other conditions.

    Contract Terms:

    All OpenPort plans are month-to-month terms.  To activate with a month-to-month plan, a $50 activation fee is billed at the time of initial activation. 

    Per-Minute billing is rounded up to the nearest whole minute for each satellite call (data or voice)

    OpenPort maximum upload and download speeds 132kbps.  Actual speeds will vary due to network, weather, and other conditions.

    If you request a plan change request with less than 72 hours’ notice, we cannot guarantee that the change will be made in time.  If you need to make a change and it is already within the 72-hour period, you may call our business number (+1-206-792-9540) to speak with us, and we will be able to tell you if it’s possible to make the change in the time remaining.

    Successful rush plan change requests (under 72 hours’ notice) will incur a $10 service fee.  There will be no fee if we are unable to complete the change in time, and your change will be rescheduled to the next billing cycle.

    All Fleet One plans are currently month-to-month terms.  To activate any Inmarsat Fleet One Plan, a $50 activation fee is billed at the time of initial activation.   There is no ETF for month-to-month plans.

    Fleet Broadband plans are available as month-to-month or with 12 month and longer terms.  ETF fee for 12-month term plans is equal to the number of months remaining in the contract OR 3 Months, whichever is lower.   ETF fee for 24-month term plans is equal to the number of months remaining in the contract or 6 Months, whichever is lower.

    Per-Minute voice call billing is rounded up to the nearest whole minute for each satellite voice call.

    Fleet One maximum upload and download speeds 150kbps.  Fleet Broadband 150/250/500 maximum upload and download speeds are 150/284/432kbps.  Actual speeds will vary due to network, weather, and other conditions as well as certain service plan terms in some cases.

    Access to our advanced data usage and control tools for Fleet One / Fleet Broadband systems will be provided on request. You may also request changes to the data control settings at any time and Sea-Tech Systems will perform the change on your behalf.

Mid-month suspends are not possible.   Suspension of an active plan can be scheduled in advance if requested.  Voice calling is still enabled while systems are in the VOIP Only status.
    • The plan MUST be active for at least a full 30 days before it can be suspended. (For example, if a plan is activated or resumed on Mar 10th, the first date on which it can be suspended is Apr 30th.
    • The monthly “VOIP Only” fee will be charged each month while the plan stays in suspended status. The amount of the monthly VOIP Only fee depends on the KVH antenna model in use.   There is no fee to switch between normal plans and the VOIP Only plan.
    • CruisersEmail, Xgate, and PredictWind monthly add-ons can be suspended as well and there is a $5 per month suspend fee for these services as well. 

    Resuming Full Service from Suspended VOIP Only Status:

    • Resumptions should be scheduled for the beginning of the month and can be scheduled in advanced if requested. Resumption can take from 1 hour to 72 hours to complete depending on system delays, periodic scheduled and unscheduled maintenance, and other factors.  Billing for resumption of service is NOT prorated.
    • Resuming CruisersEmail, Xgate, and PredictWind monthly add-ons can be resumed when needed, but mid-month resumes will incur the full monthly fee, they cannot be prorated. 

    Cancellation of Service:

    Maximum speed for Flex45 service is 6mbps download and 2mbps.  Throttle data speeds apply after monthly high-speed allotment has been consumed.  There is no guaranteed minimum speed.  Actual speeds will vary due to network, weather, and other conditions.

    $15/month Administration fee applies to all Flex45 plans including while suspended.

    For our AuraNOW plans, there are no contract terms.  The contracts are technically 24-hour contracts running from 00:00 to 23:59 UTC each day.  Plans can be activated, changed, suspended, resumed, and cancelled on any day.

    There is no ETF for AuraNOW plans.

    Maximum and Minimum data speeds are dependent on chosen plan.  Actual speeds will vary due to onboard equipment, network, weather, and other conditions.

    • Billing for the active service will be prorated based on the date of suspension. For example, if suspended on June 12th, you will be billed for June 1st through June 12th.
    • The monthly “Service” fee will be charged each month while the plan is active or suspended. The monthly suspend fee is currently $15 USD per month
    • CruisersEmail, Xgate, and PredictWind monthly add-ons can be suspended as well and there is a $5 per month suspend fee for these services as well.

    Resuming Service from Suspended Status:

    • After Cancellation, A new complete re-activation process must be scheduled to re-activate service, with 7 days advanced notice.

    Quality of Service. Sea-Tech makes no guarantee, warranty, promise, or any other commitment to you regarding the quality and/or availability of the Services. Sea-Tech shall not be liable for any outage of, or any other reduction of or interference with, the Services beyond a pro-rated discount on your bill for the amount of time that the outage of Services exists. Except as set forth above in this Section 4, Sea-Tech shall not be liable for any other damages, including, but not limited to, incidental, consequential, punitive, or any other type of damages, related in any way to any outage of, or any other reduction of or interference with, the Services.

    Customer Information. Sometimes we need to share customer information (e.g. name, location, applications used on the Services) with third parties, primarily Viasat, Inc. (“Provider”), for certain operational reasons (e.g. providing customer support, initiating Services, and other operational needs).  We respect our customers’ privacy and only do so when necessary.  When we do have to share your customer information, we endeavor to have any third parties handle and treat your customer information as confidential information that must not be disclosed or used in any way or for any reason other than the purpose of our disclosure to that third party.  We will never sell your information.  By signing up for any Services, you hereby agree to and consent to our use and disclosure of your information for these purposes. 

    Changes to Services Provided. From time to time, our suppliers may make changes to the services they provide, or to the costs of the services they provide.  If any change affects your Services or the pricing of your Services, we will notify you as soon as we practically can.  If you are unhappy with any of the changes, you may cancel or suspend your Services as provided in Paragraph 3 of this Agreement.

    Permitted Use And Restrictions On Use.

      1. Software License. Subject to the terms of this Agreement, Provider grants to you a personal, non-exclusive, non-assignable and non-transferable license to use and display the software provided by or on behalf of Provider (including any updates) (“Software”) only for the purpose of accessing the Internet access service to which you have subscribed (“Service”) on any device(s) on which you are the primary user or which you are authorized to use.  Provider’s Subscriber Privacy Policy available at www.viasat.com/legal provides important information about the software applications we utilize.  Please read the terms very carefully, as they contain important disclosures about the use and security of data transmitted to and from your devices through the Service. Unauthorized copying of all or any portion of the Software, including, without limitation, portions or items that have been merged with the Software, or the written materials associated therewith is expressly forbidden.  You may not sublicense, assign, or transfer this license or the Software except as permitted in writing by Provider.  Any attempt to sublicense, assign or transfer any of the rights, duties or obligations under this license is void and may result in termination by Viasat of this Agreement.  You agree that you will not copy, distribute, decompile, or duplicate or permit anyone else to copy, distribute, decompile, or duplicate, any part of the Software, or create or attempt to create, or permit others to create or attempt to create, by reverse engineering or otherwise, the source programs or any part thereof from the object programs or from other information made available under this Agreement. The license granted under this Section terminates upon termination of the Agreement or termination of the Service.
      2. Restrictions On Use Of The Service. You agree to comply with Provider’s Acceptable Use Policy.  You also acknowledge and agree that the Service is subject to Provider’s Network Management Policy.  Provider reserves the right to immediately terminate the Service and this Agreement if you knowingly or otherwise engage in any prohibited activity under such policies, which are available at viasat.com/legal.  You do not own or have any rights (other than those expressly granted to you) to a particular IP address, even if you are utilizing a persistent IP address.
      3. Prohibition on Resale. You agree not to use the Service for operation as a Service provider, or to run programs, equipment, or servers from the designated installation location that provide network content or any other similar services to anyone outside of such location.
      4. Security. You agree to take reasonable measures to protect the security of any devices you connect to the internet through the Service, including, without limitation, maintaining at your cost an up-to-date version of anti-virus and/or firewall software to protect your devices from malicious code, programs or other internal components (such as a computer virus, computer worm, computer time bomb or similar component).  You expressly agree that if your computer or an internet connected device becomes infected and causes any of the prohibited activities listed in Provider’s Acceptable Use Policy, Reseller may immediately suspend your Service until such time as your computer or device is sufficiently protected to prevent further prohibited activities.  You will be fully liable for all monthly fees and other charges under this Agreement during any period of suspension.  Although Provider has no obligation to monitor the Service or its network, Provider and its authorized suppliers reserve the right to monitor bandwidth, usage, transmissions, and content from time to time in order to operate the Service, identify violations of this Agreement, or to protect the Provider’s network, the Service, and other users of the Service. In all cases, you are solely responsible for the security of any device you choose to connect to the Service, including, without limitation, the security of any data stored or shared on such device(s).
      5. Privacy. Provider’s privacy policy can be found at https://viasat.com/legal (“Privacy Policy”). The Privacy Policy explains Provider’s practices relating to the collection and use of your information through or in connection with the Services. Provider’s use of your information is governed at all times by our Privacy Policy. You understand that through your use of the Services you consent to the collection and use of this information (as set forth in the Privacy Policy). If you do not agree to the terms of this Privacy Policy, please do not use the Services.
    1. Warranties and Limitations of Liability.
      1. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR AND YOUR GUESTS’, PATRONS’, EMPLOYEES’ AND OTHER END USERS’ SOLE RISK.  RESELLER, PROVIDER AND RESELLER’S AND PROVIDER’S AFFILIATES, SUBSIDIARIES, WHOLESALERS, RESELLERS, RETAILERS, DISTRIBUTORS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, EMPLOYEES, SUPPLIERS, LICENSORS AND THIRD-PARTY CONTENT PROVIDERS (COLLECTIVELY, “PARTNERS”) DISCLAIM ANY AND ALL WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, AS WELL AS ANY AND ALL WARRANTIES AS TO THE RESULTS TO BE OBTAINED FROM THE USE OF THE SERVICE, INCLUDING, WITHOUT LIMITATION, ANY MINIMUM UPLOAD OR DOWNLOAD SPEEDS AND LATENCY PERFORMANCE.  THE SERVICE IS DISTRIBUTED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE,  IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES AS TO ACCURACY, COMPLETENESS OF INFORMATIONAL CONTENT, AND NON-INFRINGEMENT.  RESELLER, PROVIDER AND THEIR RESPECTIVE PARTNERS EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY THAT THE SERVICE WILL BE ERROR FREE, SECURE, OR UNINTERRUPTED, OR WILL OPERATE AT ANY MINIMUM SPEED.  NO ORDER, ADVICE OR WRITTEN INFORMATION GIVEN BY RESELLER, PROVIDER OR THEIR RESPECTIVE PARTNERS WILL CREATE A WARRANTY NOR MAY YOU RELY ON ANY SUCH INFORMATION OR ADVICE.  WHILE PROVIDER PROVIDES YOU WITH ELECTRONIC ACCESS TO THE CONTENT AVAILABLE ON THE INTERNET, RESELLER, PROVIDER AND THEIR RESPECTIVE PARTNERS DO NOT WARRANT THE ACCURACY OF THE INFORMATION YOU OBTAIN THROUGH THE SERVICE.  RESELLER, PROVIDER AND THEIR RESPECTIVE PARTNERS HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGE TO OR LOSS OR DESTRUCTION OF ANY HARDWARE, SOFTWARE, FILES OR DATA RESULTING FROM YOUR USE OF THE SERVICE.

      1. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER RESELLER, NOR PROVIDER, NOR THEIR RESPECTIVE PARTNERS ARE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE, INABILITY TO USE THE SERVICE OR ANY BREACH OF ANY REPRESENTATION OR WARRANTY. WITHOUT IN ANY WAY LIMITING THE FOREGOING, IF FOR ANY REASON, BY OPERATION OF LAW OR OTHERWISE, ANY PORTION OF THE FOREGOING LIMITATION OF LIABILITY IS VOIDED, THEN IN SUCH EVENT PROVIDER AND RESELLER’S MAXIMUM, SOLE, AND EXCLUSIVE LIABILITY AND THE LIABILITY OF THE PARTNERS IS LIMITED TO GENERAL MONEY DAMAGES IN AN AMOUNT NOT TO EXCEED THE TOTAL AMOUNT ACTUALLY PAID TO RESELLER BY YOU FOR THE APPLICABLE SERVICE FOR THE PERIOD OF TIME COMMENCING UPON THE OCCURRENCE OF SUCH ERROR, DEFECT OR FAILURE AND CEASING UPON THE DISCOVERY OF SUCH ERROR, DEFECT, OR FAILURE, IN WHOLE OR IN PART; PROVIDED, HOWEVER, THAT IN NO EVENT WILL SUCH PERIOD OF TIME EXCEED TWELVE (12)-MONTHS. THE PARTIES ACKNOWLEDGE THAT THIS SECTION HAS BEEN INCLUDED AS A MATERIAL INDUCEMENT FOR RESELLER AND PROVIDER TO ENTER INTO THIS AGREEMENT AND THAT RESELLER AND PROVIDER WOULD NOT HAVE ENTERED INTO THIS AGREEMENT BUT FOR THE LIMITATIONS OF LIABILITY SET FORTH HEREIN. 

     

    1. No Residential or Military Use. Your satellite airtime Services are intended for non-residential and non-military use.  You agree to not use your satellite airtime Services at residential locations and for any military use.  You also represent and warrant that you are not a commercial reseller of the Services and that you will not resell any of the Services to any third-parties, except for collecting reimbursement of costs for the Services provided to your clients, charter guests, crew, and the like.
    1. Governing Law. This Agreement shall be governed, construed and interpreted in accordance with the laws of the State of Washington.  The parties to this Agreement irrevocably consent to the personal jurisdiction of and venue in the state and federal courts located in King County, Washington with respect to any action, claim or proceeding arising out of or relating to this Agreement.
    1. Authorization. I authorize Sea-Tech Systems to auto-debit my account below for any and all charges due. I understand that my information will be saved to file for future transactions to my account, and I agree to keep my payment information current as long as I am continuing to utilize Sea-Tech services.
